A commissioned Delaware notary comes to you for the signing of a will, a medical directive or a durable power of attorney. From $125 per person, notarization only.
The estate rate is $125 per person, and it is for the notarization only. It covers the three documents most Delaware estate plans are built from, signed at one appointment, at your home, an office, a hospital or a care facility.
| Document | What we do at the appointment |
|---|---|
| Last Will and Testament | Confirm identity, watch you sign, and complete the notarial certificate. Delaware also requires 2 or more credible witnesses under 12 Del. C. 202. |
| Medical Health Directive | Also called an advance health care directive or living will. Identity confirmed, signature witnessed, certificate completed. |
| Durable Power of Attorney | Identity confirmed, signature witnessed, certificate completed for the principal. |
Per person means each signer is priced separately. A couple signing their own documents at the same visit is two people.
Delaware caps the notarial act itself at $5.00. Everything above that figure is a separate travel and convenience fee that we set, and the state does not regulate. We show you both parts before the appointment and before any travel.
| Line | Amount | Set by |
|---|---|---|
| Notarial act | $5.00 | Per act, per person. Capped by the State of Delaware. |
| Travel and convenience | Balance | Set by Delaware Mobile Signings. Covers travel, scheduling around you, supplies and the journal record. |
| Typical total | from $125.00 | Per person, for the three documents above. Confirmed with you before we travel. |
Appointments between 6PM and midnight add $100. Between midnight and 6AM they add $200. Office hours are Monday to Friday, 8AM to 6PM.
We are notaries, not attorneys
Delaware Mobile Signings cannot draft your will, your directive or your power of attorney, and cannot advise you on what any of them should say, which one you need, or what signing it will mean for you or your family. Choosing and wording those documents is the practice of law.
What we do is the notarial act: confirm who you are, watch you sign, and complete the certificate. Bring documents you have already prepared, or had prepared for you. Delaware notarial practice is governed by 29 Del. C. ch. 43.
One point worth knowing before you book: under 12 Del. C. 202 a Delaware will is valid when it is in writing, signed by the person making it, and attested by 2 or more credible witnesses. Notarization is not what makes a will valid. It is commonly added alongside the witnesses, and many people want it, but if you are unsure whether your documents need it, ask the attorney or the provider who prepared them.
| Bring | Why |
|---|---|
| Unsigned documents | A notary has to witness the signature. A document already signed at home usually cannot be notarized, so leave the signature lines blank. |
| Photo ID for every signer | Government issued, unexpired, with a name matching the document. Required under 29 Del. C. 4321. Without it we cannot proceed and the travel fee still applies. |
| Every signer, in person | 29 Del. C. 4319 requires each signer to appear personally before the notary. Everyone signing must attend the same appointment unless arranged with us in advance. |
| Two witnesses for a will | 12 Del. C. 202 requires 2 or more credible witnesses, and the notary does not count as one of them. Tell us in advance if you need help arranging witnesses. |
| A workable space | A table, a light, and enough quiet for each signer to read what they are signing. We travel to homes, offices, hospitals and care facilities. |
A notary must refuse where identification is missing or invalid, where a signer does not appear to understand what they are signing, or where a signer appears to be acting under duress. That rule protects the person signing, and it matters most at exactly this kind of appointment.
We come to you anywhere in Delaware, or you can sign at the Dover or Millsboro office. Allow about an hour.
We cover New Castle, Kent and Sussex counties. Mobile appointments can be booked around the clock, including evenings and weekends, with the after-hours surcharge shown above. Our offices are in Dover at 846 Walker Road Suite 32-1, and in Millsboro at 26976 Bethesda Road.
Prefer to do it by secure video? Remote online notarization is available from $29 a session, though check first that the people receiving your estate documents will accept a remote notarization. For everyday documents outside an estate plan, see mobile notary services.
We are not attorneys, and we say so on every page. But telling you to “see a lawyer” and leaving it there is not much help, so there are two routes we can actually put in front of you.
And for USCIS paperwork we bring in a paralegal or an attorney to do the legal part, rather than turning you away. The notarial act stays ours; the legal work goes to someone qualified to do it. We will tell you which is which, and what each costs, before anything starts.
Disclosure: we are a LegalShield affiliate and receive a commission if you enrol through us. We will say so again at the time.
Both have signing rules that are easy to get wrong, and both are easier to fix before the appointment than after.
Power of attorney in Delaware — a notary is legally required, and the single witness cannot be a relative or anyone who inherits under your will.
Advance directive in Delaware — two witnesses, and none of them can be family, an heir, or staff at the facility where you are a patient.
